Presale Acknowledgement

Special Pricing: You are enrolling in a presale membership with special rates and enrollment discounts. This offer is exclusive to first-time members at the specified studio location and is non-transferable. If you cancel this membership, you forfeit the special rate.Billing Start Date: Membership billing will commence on the 1st of the month following official approval from local authorities and XFIT BURN headquarters, once the studio is ready. Delays in opening may occur due to factors such as construction, weather, and regulatory approvals.Orientation Requirement: Membership benefits can only be utilized after the studio opens and you complete the New Member Orientation at the location listed in this agreement.

Tax Notices

Applicable Taxes: Membership fees, including installment amounts, enrollment fees, freeze fees, and prorated dues, may be subject to local, state, and federal taxes. These taxes will be added to your payments as required by law.

Auto-Renewal Terms & Conditions

Auto-Renewal Details: After the initial 90-day program term, your membership will automatically renew on a month-to-month basis at the installment rate specified in this agreement.Cancellation Policy: To cancel the auto-renewal, you must provide a 90-day notice after fulfilling the initial program term. This notice must be submitted in person at the studio or via certified mail to the location where you enrolled. All outstanding balances and monthly installments due during the 90-day notice period must be paid in full at the time of cancellation.

Customer Right to Cancel

Three-Day Cancellation Right: You may cancel this contract by midnight of the third business day after signing it by sending a certified mail notice to XFIT BURN Studio Conroe, TX, or by hand-delivering the notice and obtaining a written cancellation form.Business Closure or Relocation: If the studio closes or relocates more than 10 miles away, you can cancel the contract and claim a refund by sending a certified mail notice to the specified address.Disability or Death: If you become permanently disabled or die, you or your estate can cancel the contract and receive a partial refund by providing certified mail notice and proof to the specified address.Non-Opening Refund: If the studio does not open within 181 days or does not remain open for 30 days, you are entitled to a full refund of your prepaid fees.

Payment Method

Multiple Payment Methods: You must maintain at least two payment methods (credit card, debit card, or ACH) on file to sustain the installment price. A $5 fee applies if only one method is available at the time of the monthly draft.Returned Payments: A return fee will be charged for uncollected payments due to reasons such as non-sufficient funds or declined transactions.

Membership Freeze and Reciprocity

Membership Freeze: You can request a membership freeze in person or by certified mail. A $9 monthly freeze fee applies, with a maximum freeze period of 3 months. During this period, access to the studio is restricted, and only sessions purchased during staffed hours are permitted.Reciprocity: Active members can use other XFIT BURN Studios. SWEAT EVERYWHERE members have free access, while SWEAT HERE members pay a $10 daily fee. Higher fees apply in premium markets.

Cancellation Policy

Standard Cancellation: A 90-day notice is required after fulfilling the initial program term. Immediate cancellation before the term completion incurs a $99 fee and must be done in person.Rejoining: Re-enrollment requires new terms and rates, with previous payments and discounts forfeited at cancellation.

Member Rules and Conduct

Facility Use: Members use facilities at their own risk and must follow all XFIT BURN rules and policies. Approved XFIT BURN Yoga Mat and Towel are required for all isometric workouts.Cleanliness and Behavior: Wear appropriate, clean clothing. Maintain cleanliness, avoid disruptive conduct, and do not tamper with equipment. Prohibited behaviors include drug/alcohol use, profanity, and unauthorized solicitation.Guest Privileges: Members can bring guests during staffed hours. Guests must register, provide ID, and complete necessary forms. Each guest is limited to three visits per year. Unauthorized guest access incurs a $20 fee.

Liability

Personal Injury and Property Loss: XFIT BURN is not liable for personal injuries or property loss. Members assume full responsibility for injuries and losses and release XFIT BURN from liability.

Health and Safety

Health Conditions: Notify management of any health conditions that could be aggravated by facility use. Ensure you have received medical advice before engaging in physical activities.Non-Staffed Hours: No supervision during non-staffed hours. Members are advised to have a workout partner and use panic buttons if available.

Heated Service & Infrared Exposure

Health Risks: Not recommended for individuals with specific health conditions, pregnant women, children, or those on certain medications. Discontinue use if experiencing severe fatigue, nausea, dizziness, or other symptoms. Provide a physician's letter if you have conditions affected by heat exposure.

Parental/Guardian Consent for Minors

Minor Usage: Minors (ages 12-17) require parental/guardian consent. Minors 12-15 must be accompanied by a guardian who is a paying member. Minors 16-17 can access the facility alone with 24/7 access. Violation of rules results in membership termination.
